These Terms of Use apply to summitairportsystems.com (the "Website"), operated by Summit Airport Systems, LLC ("Summit", "we"). By using the Website, you agree to these Terms. They are linked at the foot of every page, together with our Privacy Policy and Cookie Notice.
1. The Website and Summit's services
The Website describes Summit's products and how they work. Nothing on it is an offer, a service-level commitment, a certification, legal advice or an airport operational instruction.
These Terms do not apply to, amend or override any Master Subscription Agreement, Order Form or statement of work. The Summit client portal and Summit's services, including when you reach the portal through the Website, are governed only by the customer's written agreement with Summit. Sending an inquiry or asking for a demonstration does not create a subscription or oblige Summit to provide any service.
2. Demonstration flight data
Airport flight previews on the Website are historical snapshots for demonstration, and each preview shows the date it was captured. They are not live, may be incomplete or contain errors, and must not be used for travel or operational decisions. Travelers should confirm flight information directly with their airline or airport.
3. Acceptable use
You must not:
- interfere with or disrupt the Website, or bypass its security or access controls;
- test the Website for security vulnerabilities without Summit's written permission;
- impersonate any person or organization;
- collect or harvest personal information from the Website;
- use automated tools that bypass the Website's protections or place an unreasonable load on it (search engines and accessibility tools that respect the Website's controls are welcome); or
- submit unlawful, false or harmful material, spam or malicious code through its forms.
Summit may block traffic it believes is abusive and remove unlawful submissions.
4. Content and permitted use
The Website's content, design, logos and software are owned by Summit or its licensors. You may view and print pages for your own information, and download and share materials that are offered for that purpose, such as brochures, without changing them. You may not otherwise republish, sell or commercially exploit the Website's content. Airport, airline and technology names may be trademarks of their owners; their use does not imply endorsement. Photographs credited on our Legal Notices page are used under the licenses stated there.
5. Information you submit
When you submit a form, you confirm that the information is accurate and that you may share it. Summit uses it to respond to you and as described in our Privacy Policy, and does not claim ownership of what you send. Please do not send passwords, SIDA badge numbers, payment-card details or airport security-sensitive information through the Website's forms. Sending a general inquiry does not create a confidentiality agreement, but Summit still handles personal information as its Privacy Policy describes.
6. Links to other websites
Links to other websites are provided for convenience. Summit is not responsible for their content or practices.
7. Disclaimer
The Website is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. The Website may change or become unavailable without notice.
8. Limitation of liability
- (a) Summit is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Website.
- (b) Summit's total liability for all claims relating to the Website is limited to $100.
- (c) This Section does not limit liability that the law does not allow to be limited, or Summit's liability for fraud or willful misconduct.
- (d) Claims about the Summit client portal or Summit's services are governed by the customer's written agreement with Summit, not by this Section.
9. Governing law and venue
These Terms are governed by the laws of the State of Ohio. Any dispute about the Website will be heard only in the state courts located in Hamilton County, Ohio, or, where federal jurisdiction exists, the United States District Court for the Southern District of Ohio.
10. General
If any part of these Terms is found unenforceable, the rest remains in effect. Summit's failure to enforce a provision is not a waiver of it. Summit may update these Terms by posting a new version on this page with a new effective date; changes apply only from that date, and earlier versions are available on request. Updating these Terms does not change any customer's written agreement with Summit.
